1. Booking Age Requirement: You must be at least 25+ years of age to book this cabin. Booking guests must occupy the property for the duration of the reserved dates. 2. Check-In/Check-out Times: You will receive a door code prior to arrival via messaging system. CHECK-IN TIME is 4:00pm EST. CHECK-OUT TIME is 10:00am EST. These times are strictly enforced so the house cleaning crew can properly sanitize and prepare the cabin for the next guests. 3. Guest acknowledges and understands they are financially responsible for any and all property damage that may occur during the stated rental period which can reasonably be attributed to the rental party's negligence or abuse. 4. Absolutely NO SMOKING or DRUGS anywhere on the premises of the cabin, violations of this policy will result in additional fees. Violations will result in a minimum $400 cleaning fee, damage claims filed if any, plus immediate cancellation of your reservation. 5. NO PETS of any kind allowed in this cabin, violations of this policy will result in additional fees. Quiet hours are 10pm-8am, avoid excessive noise at late evening hours. Please be considerate of others, they are on vacation too. Absolutely no parties of any kind. 7. Security Features: Cabin comes equipped with safety & security devices for your protection. Cameras (motion recording) facing the cabin front door, driveway, and exterior storage closet, no cameras are located inside property or facing any private areas. Carbon Monoxide Detectors, Smoke Detectors, and Fire Extinguishers are located inside the cabin. Tampering of ANY DEVICE is not permitted and strictly enforced. All devices must remain connected and accessible at ALL TIMES. Loss of connectivity or theft of devices will result in fines and termination of agreement. 8. The Cabin is located in a mountainous region. There are a few curvy roads leading up to the cabin but a regular car will do the trick no need for 4-wheel drive unless there is snow or inclement weather. Parking spaces at the cabin are on flat ground. If inclement weather is a concern we recommend you purchase trip insurance as No Refunds will be given. 9. TV / Internet: Cabin comes equipped with multiple TV's with Roku Sticks, please do not remove Owner’s Roku Devices. Wi-Fi & Internet Provided, NO TV Service is provided. Tampering with electronic devices is not permitted. Wi-Fi Router and Modem must remain on and connected at all times. Tampering, loss, or theft of items will result in fines greater than cost of replacement. Guest may be subject to immediate cancellation without refund. 10. Starter Supplies Provided: Paper towels, Trash Bags, Dish Soap, Hand Soap, Toilet Paper, Laundry Detergent, Salt, and Pepper. These items are not replenished during the length of the stay and you may need additional supplies. 11. Hot Tub: The hot tub is drained, cleaned, and refilled prior to each guest arrival. Keep the Hot Tub temp between 100 and 104 degrees and keep the cover on the hot tub when not in use. DO NOT STEP ON COVER - Loss or damage will result in a $600 fine. 12. Fireplace: The Cabin's Gas Fireplace is seasonal and is non-operational from May 1st through October 1st. 13. Wildlife/Pest/Insect Control: This Cabin is located in the woods. Owner has the Cabin professionally cleaned and treated to give guests the best experience but we CAN NOT guarantee you won't run into any critters. NO REFUNDS of any kind will be given for issues with wildlife/pest/insects. You are also likely to encounter wildlife such as (deer, bears, racoons, snakes, birds and bugs of various types, including wasps, bees and/or hornets, etc). We ask that if you do see wildlife, please admire these creatures from a safe distance and please DO NOT FEED THE WILDLIFE. We want to preserve the wildlife in its natural state and try not to humanize the animals for their safety as well as yours. 14. Lost & Found: Owner is not responsible for any personal property from the guest left behind or lost. Cleaners will do their best to keep an eye out but there will be no refunds or assistance guaranteed to the guest. 15. Violation of Agreement: If any violation occurs, the Owner or representatives of the Owner may enter the premises and/or immediately terminate this Agreement. Any guest found to violate any house rule is subject to immediate removal and will forfeit all monies, deposits, and fees. As of the acceptance date of this booking all guests agree to abide by the required rental agreement terms below: This Short-Term Rental Agreement (the “Agreement”) is made by and between Tamera and Conrad Harvey, Owners of The Smoky Mountain Retreat Cabin and GUEST, (“Guest”) as of the electronic acceptance date of this booking. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property. The property is furnished and includes household appliances, furnishings, decorations, artwork, linens, towels, kitchenware, audio/video equipment and personal property. 2. Rental Party/Maximum Occupancy: The rental party shall be limited to the number listed on the rental reservation. The maximum number of guests is limited to 4 persons for The Smoky Mountain Retreat, unless a specific written exemption has been made by the Owner. An additional charge of $100 minimum per person per night for guests in addition to above guests may be assessed. At all times during said rental period, Guests agree to have no more than the allowed number of guests for occupancy, (including children). If more than the stated number of guests are found to be occupying the unit, without prior written permission, Owner has the right to terminate this contract and Guest will forfeit all monies paid, including rent, cleaning, and deposits. 3. Term of the Lease. The rental period begins at 4pm on the dates in the reservation and will end at 10am, on the check-out date. Check in time is 4pm and check out time is 10am. 4. Rental Rules: Guest agrees to abide by the Rental Rules attached as Addendum A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Should Guest violate these rules, Owner reserves the right to cancel this rental immediately with no refund due to Guest. 5. Noise: Guest understands and agrees that they, and all members of their rental party will be respectful to our neighbors, including, driving slowly on the road to the property, not creating any noise (including music) which the neighbors can hear, especially in the evening and during the night. Any violation of this rental agreement and Guest will be required to leave immediately, with no refund for any unused rental time. 6. Access: Guest shall allow owner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 7. Rental Rate and Fees: The rental rate shall be as stated on booking platform. 8. Security Deposit: Guest shall deposit a security deposit per the terms of booking platform for any damages to the property. Said security deposit shall be returned to Guest after departure, less any deductions for damages. In addition, should said damages exceed coverage, Guest hereby assumes all liability for reimbursement to the Owner for any damages caused by Guest and their party within 5 (five) business days of receipt of invoice from Owner. 9. Condition of Property: Guest shall return the premises in the same condition as received. As a part of the rental agreement, Guest will pay a cleaning fee as disclosed on the booking platform which includes normal “turn” cleaning.
